- 01Trash Pandas – Terms & Conditions of Service Last updated: [Insert date] By booking, purchasing, or subscribing to any service provided by Trash Pandas (“we,” “us,” or “our”), you (“the Customer”) agree to the following Terms & Conditions. 1. Services Covered These Terms & Conditions apply to all services offered by Trash Pandas, including but not limited to: • Wheelie Clean Bin Cleaning Services • Bonus Bin Day Service • Bin Concierge (Roll-In / Roll-Out) • Bin Bundle & Bin Boss Bundle subscriptions • One-Time Bin Cleaning • Driveway & Concrete Cleaning • Nano-Tech Driveway Sealing • Bulk / Oversized Item Collection • Any future services offered under the Trash Pandas brand 2. Service Commitment & Term Length 2.1 One-Time Bin Cleans One-time bin cleaning services are not subject to a contract term and are billed as a single, standalone service. 2.2 Subscription & Recurring Services All recurring or bundled services — including but not limited to bin cleaning subscriptions, Extra Garbage Day, Bin Concierge, Bin Bundles, Bin Boss Bundles, and any recurring driveway or exterior services — are subject to a minimum twelve (12) month commitment beginning on the service start date. By enrolling in any recurring service, the Customer agrees to remain subscribed for the full 12-month term. 3. Cancellation & Early Termination 3.1 Cancellation After Commitment Period After completion of the initial 12-month commitment, services may be cancelled without penalty by providing a minimum of 30 days’ written notice prior to the next billing cycle. 3.2 Early Cancellation & Termination Fees If a Customer cancels or terminates a service before completing the 12-month commitment, Trash Pandas reserves the right to charge an early termination fee. The early termination fee will be the lesser of: • The remaining balance of the 12-month commitment, or • 50% of the remaining contract value, or • Recovery of any discounts, promotional pricing, bundle savings, or founder pricing applied during the service term Early termination fees are intended to recover operational, scheduling, administrative, and equipment costs incurred as part of the agreed service commitment. 4. Billing Authorization & Payment Terms By purchasing or subscribing to any service, the Customer authorizes Trash Pandas to charge the provided payment method on a recurring basis in accordance with the selected service and billing schedule. • Payments are processed securely through third-party payment providers (including Stripe) • The Customer is responsible for ensuring payment details remain valid and up to date • Failed, declined, or reversed payments may result in service suspension or termination Trash Pandas reserves the right to recover unpaid balances, including applicable termination fees, through additional billing attempts or lawful collection methods. 5. Missed Services & Access Customers are responsible for ensuring bins, driveways, and service areas are: • Properly placed • Accessible • Free from obstructions If service cannot be completed due to lack of access, improper placement, or blocked service areas, the visit may be considered fulfilled and is not guaranteed to be rescheduled. 6. Acceptable Waste & Proper Use For bin-related services, only waste permitted under the City of Calgary black bin program may be placed in Trash Pandas bins. Prohibited items include (but are not limited to): • Hazardous or flammable materials • Batteries or electronics • Paints, chemicals, or liquids • Construction or renovation debris (unless explicitly arranged) Improper use may result in additional fees, service suspension, or termination. 7. Weather, Safety & Operational Delays Service schedules may be adjusted due to: • Weather conditions • Safety concerns • Equipment issues • Municipal collection changes Trash Pandas will make reasonable efforts to reschedule affected services where possible but does not guarantee service on a specific date. 8. Limitation of Liability Trash Pandas is not responsible for: • Pre-existing damage • Normal wear and tear • Damage resulting from improper bin use or prohibited materials • Indirect, incidental, or consequential damages Our total liability is limited to the value of the service provided for the affected visit. 9. Suspension & Termination of Service Trash Pandas reserves the right to suspend or terminate services for: • Non-payment • Repeated access issues • Misuse of bins or services • Violation of these Terms & Conditions Suspension or termination does not waive the Customer’s obligation to pay outstanding balances or applicable termination fees. 10. Governing Law & Jurisdiction These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Alberta. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada. 11. Changes to Terms Trash Pandas reserves the right to update or modify these Terms & Conditions at any time. Continued use of services constitutes acceptance of the updated terms. 12.
